Court of Foggia: a field of industrial hemp was released from seizure
On September 19, 2025, the Court of Foggia issued a significant ruling for the light hemp sector.
The case concerned the seizure of a field cultivated with certified seeds, ordered on the basis of Article 18 of the 2025 Security Decree, which introduced a ban on the commercialization of light cannabis.
The Foggia judges ruled that the cultivation in question could not be classified as a criminally relevant conduct. The reasoning emphasized that Law 242 of 2016 permits the cultivation of industrial hemp from EU-certified seeds, and that criminal intervention is only justified if the final product has a THC content that would produce a narcotic effect.
The Court therefore ordered the release of the field, reiterating that the absence of harmfulness is an essential criterion: one cannot speak of a narcotic substance when THC values are within the prescribed limits and there is no danger to public health.
This ruling is part of a jurisprudential framework that in recent years has repeatedly seen judges distinguish between industrial hemp and narcotic substances, recalling that Article 73 of the Consolidated Law on Narcotics (d.P.R. 309/1990) applies only in cases where the substance has an actual narcotic effect.
For growers and companies in the sector, the signal is clear: the mere presence of certified hemp cultivation does not automatically constitute an offense, but the real nature of the product must be evaluated.
