Our legal battle against the Municipality of Ventimiglia: what really happened
Introduction
In recent months, we have received dozens of messages from customers, colleagues, and industry professionals asking what was happening at our Ventimiglia store.
Many had read articles about the matter, others had seen news circulating on social media, but almost no one truly knew the full story from the beginning.
For this reason, we decided to tell it directly.
Not to fuel controversy or seek visibility, but because we believe that transparency is the best way to explain what happened, why we decided to appeal to the Liguria Regional Administrative Court (TAR), and what that decision means for our company today.
It all started with an investment
When we decided to open our store in Ventimiglia, we did so with enthusiasm.
Ventimiglia is a strategic city, frequented daily by both residents and thousands of people from nearby France.
As with every new opening, we invested time, economic resources, and effort, believing we could carry out our business in full compliance with current regulations.
Every product in our store is accompanied by certifications and laboratory analyses that attest to its characteristics.
For us, this has never been a mere bureaucratic formality, but a fundamental principle: to operate with seriousness and transparency.
The Municipal Ordinance
When we received the order from the Municipality of Ventimiglia mandating the cessation of sales of industrial hemp inflorescences, our first reaction was surprise.
Not because we were unaware of the complex period the sector is going through, but because we were convinced that we had always operated in compliance with the law.
The feeling was that we were subjected to a measure that, in our assessment, did not adequately consider the characteristics of the products marketed or the existing legal framework.
Why we decided to appeal
Many have asked us why we didn't simply close the store or stop selling the inflorescences.
The answer is simple.
We had made a significant financial investment and felt it was right to defend our work.
When an entrepreneur is convinced that they have operated correctly, we believe the path to follow is that provided by the rule of law: to turn to the courts.
That is why we decided to appeal the measure before the Liguria Regional Administrative Court (TAR).
Not to challenge institutions.
But to ask a judge to assess the correctness of the situation.
The TAR's decision
In recent days, an initial response has arrived.
The Liguria Regional Administrative Court (TAR) accepted our precautionary request, suspending the effects of the municipal measure pending the decision in the main case.
It is important to be clear on this point.
This is not yet the final judgment.
The proceedings are still ongoing, and the judgment on the merits will definitively establish the legitimacy of the challenged measure.
However, the precautionary decision represents a significant step because the Court found that there were grounds to temporarily suspend the effects of the ordinance.
How we felt
When we received the news, we felt deeply satisfied.
Not so much because we consider this a definitive victory, but because it strengthened the trust we have always had in the Italian judicial system.
From day one, we chose to address this matter through the appropriate channels, without fueling controversy and without seeking shortcuts.
When one is convinced that they have operated in accordance with the law, we believe it is right to trust the judges.
A message for the entire sector
In recent months, many entrepreneurs have written to us to ask how we were handling this situation.
We understand the concerns of those operating in the industrial hemp supply chain.
Precisely for this reason, we believe that this incident has sent an important signal.
We chose not to let uncertainty paralyze us.
We decided to defend our positions through the appropriate channels and, at the same time, continue to invest.
The most concrete demonstration is that PureCBD continues to grow and has already planned new openings in the coming months.
Our confidence in the future does not stem from an act of optimism, but from the conviction of operating responsibly and in compliance with regulations.
Our relationship with institutions
We wish to clarify an important aspect.
This matter did not arise from a confrontation with institutions.
On the contrary, we believe it is essential that businesses and public administrations collaborate with mutual respect and adherence to rules.
Our hope is that public bodies can always support those who invest in the local area and operate in good faith, focusing their resources on problems that genuinely affect the safety and quality of life of citizens.
Dialogue between businesses and institutions is essential but should always be based on technical, objective assessments and respect for the law.
What happens next
The proceedings before the TAR are not concluded.
In the coming months, the judgment will continue until the decision on the merits.
As we have done from the beginning, we will continue to follow every phase with respect for the work of the judiciary and with maximum transparency towards our customers.
When there are significant developments, we will report them on this blog.
Because we believe that those who choose PureCBD have the right to know not only our products but also the values with which we approach our work every day.
